If we modify these Terms during the Initial Term and we have agreed fixed obligations for you for the Initial Term in an Order Confirmation, the modified version of these Terms in respect of those fixed obligations will be effective at the end of the Initial Term.

Feedback, suggestions, comments and requests (“comments”) may be made via the ‘Contact Us’ page. However if you do make comments, you acknowledge that: they will not be considered confidential or proprietary, and Blue Hope Consulting Pty Ltd is under no obligation to keep such information confidential, and Blue Hope Consulting Pty Ltd will have an unrestricted, irrevocable, world-wide, royalty free right to use, communicate, reproduce, publish, display, distribute and exploit such comments in any manner it chooses.

  1. Fees and charges

You agree to pay Blue Hope Consulting Pty Ltd for the Services at the rates set out in the Proposal/Contract, plus any GST or other taxes, levies or government charges that may be payable in respect of the Services.  If the scope of Services changes during the term of this Agreement, you will be informed of any additional fees required to be charged by Blue Hope Consulting Pty Ltd.

  1. New Material

Blue Hope Consulting Pty Ltd will own all intellectual property and other rights in all material, documents and other products developed or brought into existence in the course of providing the Services to our Clients.

  1. Inbound links

Blue Hope Consulting Pty Ltd is open to requests to link to its website. These requests may be made via the ‘Contact Us’ page on the website. Links may only be made once express written permission is granted by Blue Hope Consulting Pty Ltd.

  1. Outbound links

Blue Hope Consulting Pty Ltd grants you a non-transferable, perpetual and royalty-free licence to use the Deliverables for your internal purposes and to make as many copies of the Deliverables as is reasonably required for those purposes.  This licence will automatically be revoked in the event that you fail to pay Blue Hope Consulting Pty Ltd the fees for the Services as set out above.

If Blue Hope Consulting Pty Ltd is found responsible for any damages, Blue Hope Consulting Pty Ltd is responsible for actual damages only. In no event shall Blue Hope Consulting Pty Ltd, be liable for any incidental, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the website.

Unless expressly provided by Blue Hope Consulting Pty Ltd, any other information provided or otherwise made available by Blue Hope Consulting Pty Ltd in any form, including in any Products or Services, for any reason, you do so at your own risk.
